Employment Law
Another important area of our practice involves representation of management companies as employers. We defend EEO and Title VII employment discrimination claims filed with the U.S. Equal Employment Opportunity Commission (EEOC), as well as related litigation in federal court. Frequently we consult with clients on topics such as the Family and Medical Leave Act (FMLA), Americans with Disabilities Act (ADA), Pregnancy Disability Act (PDA), Fair Labor Standards Act (FLSA), and Age Discrimination in Employment Act (ADEA). We provide consultation regarding sexual harassment, unemployment compensation, unpaid compensation, salary, or bonuses, and other matters and assist clients in handling difficult employment terminations.
Fair Housing
A significant number of our cases involve defense of fair housing claims. We represent apartment owners and managers before the U.S. Department of Housing and Urban Development (HUD) and the Georgia Commission on Equal Opportunity (GCEO), South Carolina Human Affairs Commission, and Florida Commission on Human Relations.  Many cases involve administrative complaints alleging some form of housing discrimination. Under Title VIII or the Georgia Fair Housing Act, many claims involve allegations that a resident or applicant was treated unfairly because of his or her race, family status, or disability.  Claims may include alleged violations of the design and construction requirements of the Fair Housing Act Amendments of 1988. The firm also defends fair housing litigation claims filed in federal and state courts.
Seminars and Training
Our firm is committed to continuing education of its attorneys and clients. We offer seminars and training on housing discrimination, landlord and tenant laws, leases, employment practices, premises liability, and many other topics. Training is offered either through the Education Department of the Atlanta and Georgia Apartment Associations or for individual clients. We provide written materials that clients can use to document good faith efforts to comply with various laws and best management practices.
Lease Review and Revision
Because of our familiarity with residential landlord and tenant laws, our knowledge of the most commonly used residential lease forms, and our extensive court practice, we are uniquely poised to counsel clients on the most appropriate lease provisions and addenda.
Dispossessory Proceedings
Our firm appears in courts throughout the greater Atlanta metropolitan area on a daily basis. These cases may involve nothing more than a simple failure to pay rent due, or they could involve more complex issues, such as alleged failure to make repairs, negligent security, mold, or difficult lease termination issues. Lease terminations involve domestic disputes, noise complaints, difficult and unreasonable residents, drug related activity, gangs, and criminal complaints. The firm handles a significant number of post-foreclosure dispossessory proceedings for other Atlanta law firms to obtain possession of houses which have been sold through the foreclosure process.
Bankruptcy Stay Litigation
It is not unusual for eviction cases to involve bankruptcy filings by the apartment resident. We have considerable experience representing owners and managers in federal bankruptcy court to obtain relief from the automatic stay imposed upon filing and notice to the management company.
Dispossessory Filings
We routinely file dispossessory proceedings in all major metropolitan courts, as well as many other counties in North Georgia, to obtain possession of apartments in cases where rent was not paid or the lease has been terminated or non-renewed due to a lease violation. We offer fast and cost-effective filings using a proprietary Dispossessory Management System.
Client Profile
Robert P. Hein, P.C.’s practice group primarily limits its representation to apartment owners and managers.  Mr. Fowler represents several Georgia cities, many small business owners, and individual clients in divorce, traffic offenses, and real estate closings.
