All cities and counties have ordinances that require apartment owners to maintain and repair the apartment community to comply with certain minimum occupancy standards. These are called property maintenance codes. Inspections triggered by a tenant complaint can result in issuance of citations by a code enforcement officer for alleged violations that will have to be addressed in court. Other times a county fire marshal may issue a notice to correct violations of the governing Life Safety Code which deals with preventing loss of life in the event of a fire. Both kinds of citation can result in costly repairs, civil penalties, and attorney’s fees. There may be differences of opinion between the code enforcement officials or fire marshals and the building owners as to the alleged code or fire violation.
